MaxxBets is not a sportsbook, does not accept wagers, bets, or real-money deposits, and does not facilitate gambling transactions. All data, odds, and analytics are provided for informational and entertainment purposes only. These Terms constitute a legally binding agreement between you and MaxxBets Inc. ("MaxxBets," "we," "us," or "our"). By using the Service, you represent and warrant that you have the legal capacity and authority to enter into this Agreement.

MaxxBets provides real-time sports betting odds aggregation, arbitrage opportunity detection, positive expected value calculations, and bet tracking tools. Features and availability may vary between platforms. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

You must be at least 18 years of age (or the minimum legal age for sports betting in your jurisdiction, whichever is higher) to access or use the Service. In jurisdictions that require a higher minimum age, such as 19+ in certain Canadian provinces or 21+ in certain U.S. states, you must meet the applicable age requirement. By using the Service, you represent and warrant that: • You meet the minimum age requirement applicable in your jurisdiction • You have the legal right and ability to enter into this Agreement • You are not prohibited by law from using sports betting analytics services • Your use of the Service complies with all applicable local, state, provincial, national, and international laws and regulations We reserve the right to request proof of age at any time and to suspend or terminate accounts where eligibility cannot be verified.

To access certain features of the Service, you must register for an account. You agree to: • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Maintain the security and confidentiality of your password and account credentials • Accept all responsibility for activity that occurs under your account • Notify us immediately of any unauthorized use of your account or any other breach of security You may not create multiple accounts to abuse free trials, promotions, or any other feature of the Service. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

MaxxBets offers both free and paid subscription tiers, including MaxxBets Elite. Free Trial • We may offer a 7-day free trial for new subscribers to MaxxBets Elite • During the trial period, you can cancel at any time without being charged • Any unused portion of a free trial period will be forfeited when you purchase a subscription to the same service Subscriptions Purchased via the Website • Subscriptions purchased through our website are billed on a recurring basis (monthly or annually) • Payments are processed securely through Stripe • We do not store your payment card information on our servers • You authorize us to charge your selected payment method for all applicable fees • You can cancel your web subscription at any time by contacting support@maxxbets.ca or through your account settings • Cancellation takes effect at the end of the current billing period • After the trial period ends, subscription fees are non-refundable except as required by applicable law Subscriptions Purchased via the iOS App (Apple In-App Purchase) • Payment will be charged to your Apple ID account at the confirmation of purchase • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan • You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription • Prices for subscriptions may vary by region and are displayed in your local currency in the App Store General • We may change subscription prices with 30 days' notice • Price changes will not affect your current billing period • All subscriptions provide access to the same tier of features regardless of the platform of purchase

You are solely responsible for your betting decisions and activities. MaxxBets provides data and analytical tools, but: • We do not guarantee the accuracy, completeness, or timeliness of odds or opportunities displayed • We are not responsible for losses resulting from any betting decisions you make • Past performance of any strategy, tool, or data point is not indicative of future results • You must comply with all applicable gambling laws and regulations in your jurisdiction • You are responsible for determining whether sports betting is legal in your jurisdiction • You are responsible for reporting and paying any applicable taxes on gambling winnings • You must use the Service in accordance with all applicable laws You acknowledge that odds and data displayed on MaxxBets are sourced from third-party sportsbooks and may contain errors, delays, or inaccuracies. MaxxBets does not verify the accuracy of third-party data and shall not be held liable for discrepancies. Sports betting involves financial risk. Only bet with money you can afford to lose.

You agree not to: • Use the Service for any illegal purpose or in violation of any applicable laws • Attempt to gain unauthorized access to our systems, networks, or user accounts • Interfere with or disrupt the Service, servers, or connected networks • Use automated systems, bots, scrapers, or crawlers without our prior written permission • Resell, redistribute, sublicense, or commercially exploit our data or services • Create multiple accounts to abuse free trials, promotions, or referral programs • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service • Violate any intellectual property rights of MaxxBets or third parties • Transmit any malware, viruses, or other harmful code • Impersonate any person or entity, or misrepresent your affiliation with any person or entity • Use the Service to facilitate money laundering or other financial crimes Violation of these terms may result in immediate account termination without refund and may subject you to legal action.

All content, features, functionality, software, algorithms, and data compilations of the Service are owned by MaxxBets Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include: • Resale or commercial use of the Service or its contents • Collection, aggregation, or use of data listings, odds, or analytics for competing purposes • Making derivative works based on the Service or its contents • Downloading, copying, or distributing account information for the benefit of third parties • Any use of data mining, robots, or similar data gathering and extraction tools Our name, logo, trademarks, and service marks may not be used without prior written consent. MaxxBets is not affiliated with, endorsed by, or sponsored by any sportsbook, sports league, sports team, or odds provider. All third-party trademarks, logos, and brand names displayed within the Service belong to their respective owners and are used for identification purposes only.

No content on the Service constitutes a recommendation to place a specific wager. All wagering decisions are made solely at your own discretion and risk. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, GAMBLING LOSSES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO MAXXBETS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50 CAD), WHICHEVER IS GREATER. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you. Upon receiving a verified deletion request, we will delete your account and associated data within 30 days, except where retention is required by law or for legitimate business purposes as described in our Privacy Policy. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to: • Breach of these Terms of Service • Request by law enforcement or government agencies • Discontinuation or material modification of the Service • Unexpected technical issues or security concerns • Fraudulent, abusive, or illegal activity • Extended periods of inactivity • Non-payment of applicable fees You may terminate your account at any time by deleting your account through the app settings or by contacting support@maxxbets.ca. Upon termination: • Your right to use the Service will immediately cease • Any outstanding subscription fees remain due and payable • We may delete your account data in accordance with our Privacy Policy • For iOS subscriptions, you must separately cancel your subscription through the App Store to avoid continued billing All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in the State of Delaware, United States, and you irrevocably consent to the personal jurisdiction and venue therein. Before initiating any formal legal proceedings, you agree to first attempt to resolve disputes informally by contacting us at support@maxxbets.ca. We will make reasonable efforts to resolve your concern within 30 days. Nothing in these Terms affects the statutory rights of consumers that cannot be waived or limited by contract under applicable law. If you are a consumer in the European Union, European Economic Area, or the United Kingdom, you may also be entitled to bring proceedings in the courts of your country of residence.

We reserve the right to modify or replace these Terms at any time. We will provide notice of material changes by: • Posting the updated Terms on this page • Updating the "Last Updated" date at the top • Sending an email notification to your registered email address for material changes • Displaying an in-app notification when material changes are made Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and MaxxBets Inc. regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by MaxxBets Inc. You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms without restriction.

The following terms apply to your use of the MaxxBets iOS application downloaded from the Apple App Store. These terms are required by Apple Inc. and supplement the rest of this Agreement. Acknowledgement This Agreement is between you and MaxxBets Inc. only, and not with Apple Inc. ("Apple"). MaxxBets Inc., not Apple, is solely responsible for the MaxxBets application and its content. This Agreement may not conflict with the Apple Media Services Terms and Conditions. Scope of License The license granted to you for the MaxxBets application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license also permits access to the application by other accounts associated with you via Family Sharing or volume purchasing. Maintenance and Support MaxxBets Inc. is solely responsible for providing any maintenance and support services with respect to the MaxxBets application, as specified in this Agreement or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application. Warranty MaxxBets Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be MaxxBets Inc.'s sole responsibility. Product Claims MaxxBets Inc., not Apple, is responsible for addressing any claims you or any third party may have relating to the MaxxBets application or your possession and/or use of the application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the application's use of HealthKit and HomeKit frameworks, if applicable. Intellectual Property Rights In the event of any third-party claim that the MaxxBets application or your possession and use of the application infringes that third party's intellectual property rights, MaxxBets Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. Legal Compliance You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. Third-Party Terms of Agreement You agree to comply with all applicable third-party terms of agreement when using the MaxxBets application, including your wireless data service agreement and any applicable sportsbook terms of service. Third-Party Beneficiary You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
